TERMS & CONDITIONS FOR SELLING DEVICES TO BIG SKY RECYCLING (BUYBACK PROGRAM)
INTRODUCTION
BigSkyRecycling.com, owned and operated by BIG SKY RECYCLING LLC (hereinafter “BIG SKY RECYCLING”), provides an online platform for consumers, businesses, and organizations (hereinafter “PARTICIPANT”) to sell used cell phones, smartphones, and tablets (hereinafter “PRODUCT”). The use of BigSkyRecycling.com and participation in the Buyback Program are governed by this User Agreement (“AGREEMENT”). By using this website and submitting PRODUCT for buyback, PARTICIPANT agrees to the terms and conditions set forth herein.
ELIGIBILITY TO CONTRACT
BigSkyRecycling.com is only available to PARTICIPANT(s) who are 18 years of age or older and can form legally binding contracts under applicable law.
TITLE & OWNERSHIP
PARTICIPANT represents and warrants that they are the legal owner of the PRODUCT or have full authority to sell it. All PRODUCT must be free of any liens, encumbrances, or claims by third parties. Title and ownership of PRODUCT transfers to BIG SKY RECYCLING upon receipt and acceptance of PRODUCT at its facility in Portland, Oregon.
If PRODUCT is from a "Lost and Found," PARTICIPANT agrees to comply with all applicable state or regional laws regarding the disposition of lost & unclaimed property, including compliance with applicable waiting periods and coordination with local law enforcement, if required. PARTICIPANT is solely responsible for ensuring compliance with these laws, and BIG SKY RECYCLING assumes no liability for legal compliance in such matters.
PRODUCT VALUATION
The value assigned to PRODUCT (“VALUATION,” “PRICE,” or “PAYMENT”) is determined solely by BIG SKY RECYCLING based on cosmetic condition, functionality, and activation lock status. Valuation is determined through diagnostic testing and inspection methods conducted at BIG SKY RECYCLING's discretion.
All PRICES listed on the BigSkyRecycling.com website or any promotional materials are estimates only and are subject to change without notice.
PRODUCT that fails diagnostic testing, is excessively damaged, has no power, or includes activation locks (e.g., iCloud, Google, Samsung, MDM/DEP) may receive a reduced value or be deemed Beyond Economic Repair (BER). In such cases, the final payment may be significantly lower than the quoted estimate.
BIG SKY RECYCLING will not be responsible for discrepancies in model, quantity, or condition and will not contact PARTICIPANT after final valuation. All valuations are final.
SHIPPING
PARTICIPANT is responsible for ensuring that PRODUCT is packaged securely. If using a BIG SKY RECYCLING provided shipping label, PARTICIPANT acknowledges that the shipment is not insured. BIG SKY RECYCLING is not liable for any loss, damage, or missing contents that occur during shipping.
PARTICIPANT retains title to PRODUCT until delivery is confirmed at BIG SKY RECYCLING’s facility. Participants may choose to ship at their own expense and with insurance, if desired.
RIGHT TO CANCEL
BIG SKY RECYCLING reserves the right to cancel or void any buyback transaction at any point prior to issuing payment. If a transaction is canceled, PRODUCT will be returned to PARTICIPANT at no cost, provided a valid return address was supplied. BIG SKY RECYCLING reserves the right to dispose of PRODUCT if return shipment is undeliverable or refused.
PAYMENT
Payment will be issued following final evaluation and acceptance of PRODUCT. All payments are made via check sent by USPS mail. Payment typically occurs within 7 to 21 business days after PRODUCT is received and evaluated, but may vary.
BIG SKY RECYCLING is not responsible for payment delays caused by incorrect contact or payment information provided by PARTICIPANT.
WIRELESS SERVICE
It is the responsibility of PARTICIPANT to deactivate all wireless service plans associated with PRODUCT before shipping. BIG SKY RECYCLING is not liable for any ongoing service charges. Any issues related to billing or service must be resolved directly between PARTICIPANT and their wireless provider.
PERSONAL DATA
PARTICIPANT should remove all personal data, SIM cards, and memory cards before shipping PRODUCT. While BIG SKY RECYCLING uses data-erasure procedures for accepted devices, data removal is not guaranteed. PARTICIPANT releases BIG SKY RECYCLING from any liability for data remaining on or removed from PRODUCT.
Devices with activation locks may be refused or receive reduced value.
PRIVACY & COMMUNICATION
BIG SKY RECYCLING may send email notifications regarding shipment, valuation, and payment. PARTICIPANT may opt out of promotional emails at any time using the unsubscribe link included in such communications.
INDEMNIFICATION
PARTICIPANT agrees to indemnify and hold harmless BIG SKY RECYCLING from any liability, claims, damages, or losses resulting from the sale, ownership, or shipment of PRODUCT.
AMENDMENT
This AGREEMENT may be amended at any time. Changes will be posted on BigSkyRecycling.com and are effective immediately upon posting.
TERMINATION
BIG SKY RECYCLING may suspend or terminate PARTICIPANT’s access to the Buyback Program at any time for noncompliance or at its discretion.
GOVERNING LAW
This AGREEMENT shall be governed by the laws of the State of Oregon, without regard to its conflict of law principles.
